General terms and conditions (GTC) – European Artistic Gymnastics Championships Basel 2021 Association («Verein EM Kunstturnen Basel 2021»)
Preamble
The contractual partner is the Verein EM Kunstturnen Basel 2021, Wallstrasse 12, 4051 Basel, Switzerland, hereinafter called «Basel 2021».
§ 1 Website use
Basel 2021 makes all efforts to ensure secure operation of its website. However, faults such as data loss or falsification, virus attacks, service operations, etc. cannot be excluded. Access to the website www.basel2021.com or a ‘redirect domain’ is at the user’s own risk and is on his or her personal responsibility.
§ 2 Exclusion of liability
Basel 2021 declines all liability for damage or ensuing harm resulting from access to its website or parts thereof (e.g. downloaded documents), from their use, or the impossibility of such use or access, and from links to other websites.
§ 3 Caveat emptor clause
Basel 2021 takes all reasonable care to ensure that information on the website is correct and current at the time of publication and does not injure third-party rights. However, Basel 2021 cannot guarantee the precision, reliability or completeness of the information.
§ 4 Linked websites and framing
The website contains links to third-party sites. Basel 2021 assumes no responsibility for their content, the products, services or other elements offered there, nor for these sites’ observance of data protection regulations. Activation of a link remains the responsibility of the user.
§ 5 Conclusion of contract
- The offers on the website represent a non-binding proposal to customers to order from Basel 2021.
- By submitting a completed order form via the internet, the customer accepts the offer by Basel 2021. Before final submission, an overview page enables customers to check and if necessary change their entries.
- Unless the customer expressly forbids this, the personal data entered can be used for promotional purposes. The data will not be passed to third parties.
- The contract takes effect as soon as Basel 2021 sends the customer the ordered product and invoice.
§ 6 Postponement and cancellation of an event
- If an event has to be postponed or the location changed, the ticket remains valid for the new date or place, regardless of the reasons for the alteration. Ticket returns or exchange are excluded.
- If an event is cancelled, the ticket must be returned to the organizer or ticket provider within 30 days of the original event date. Only the price printed on the ticket will be reimbursed. This sum will be paid into the bank or post office account designated by the customer. Repayment requires indication to the organizer or ticket provider of the following: the financial institution’s name, address, Clearing Number, IBAN, account number and the first and family name of the account holder.
- For events cancelled because of force majeure, a handling fee of about CHF 5 per ticket will be subtracted from the repayment. Force majeure indicates occurrences outside the reasonable control of one of the parties and which prevent Basel 2021 from meeting its contractual obligations. Examples include war, terrorist attacks, strikes, epidemics, pandemics, natural disasters, government restrictions or bans, etc., regardless of whether such occurrences were foreseeable at the time of ticket purchase. Force majeure also includes any consequences of such occurrences that, on careful consideration as a trader, put the wisdom of staging the event into serious doubt, even if the original occurrence itself has already passed by the intended time of the event. Basel 2021 declines any liability for possible damage incurred by customers as a result of force majeure cancellations. Basel 2021 recommends purchase of ticket insurance together with the tickets.
- If an event has to be cancelled for technical reasons or because of a serious accident with life-threatening injuries to a participant, the organizer can cancel the relevant competition regardless of its duration hitherto. The event is regarded as having been staged as soon as it begins. The organizer cannot be made liable if the event cannot be completed for reasons beyond its control (force majeure such as fire, natural catastrophes, war, terrorism, strikes, power cuts).
- For events consisting of several competitions (for one or more persons), the organizer is under no obligation to complete all such competitions (e.g. in the case of an athlete’s injury or illness).
§ 7 Pricing
- The prices listed on www.ticketcorner.ch are in Swiss francs only and include VAT. Those listed on www.eventim.de are in Euros only and include VAT. Handling fees and delivery are not included. These will be charged separately.
- Basel 2021 reserves the right to adjust the prices at any stage. Customers are required to pay the prices given on the day of ordering.
§ 8 Ticket purchases
- Every spectator requires a ticket. Children under 14 are only admitted in the company of an adult. The organizer cannot be held responsible for any age recommendations. The decision whether attending the event is suitable is entirely the responsibility of the spectator or the accompanying person.
- Basel 2021 allocates the seats. If necessary, Basel 2021 may subsequently move seating within the same category or to the next higher category.
- Purchasers have no right to reimbursement of the ticket price, unless entry is refused for an important reason not occasioned by the ticket-bearer or in the cases described in § 6.2. Any exchange of tickets is entirely at the organizer’s discretion.
- If a ticket is lost, stolen or damaged, a replacement can be ordered from Ticketcorner (Tel. 0900 800 800) for a handling fee. The original ticket then loses its validity and only the replacement ticket enables admittance.
- Tickets must be protected from moisture, heat, dirt, damage and mechanical or optical tampering. Any barcode must remain machine-readable.
- Personalized Tickets
a. Basel 2021 has the right to personalize tickets. For this purpose, personal details of the entitled user may be printed on the ticket. Only that named person is admitted to the event booked. Purchasers of tickets for more than one person must ensure that the personal details of all the people involved are complete and truthful.
b. Basel 2021 has the sole right of decision whether and on what conditiions personalized tickets may be assigned to another person. Any permission for reassignment applies only to the original purchaser.
- Onward sale of tickets
Tickets and free passes may not be sold on to third parties. Basel 2021 will conduct appropriate checks, can declare resold tickets invalid, and reserves the right to take legal proceedings. - Sponsors, partners and other recipients of free passes are not allowed to sell these. - Tickets may only be purchased from providers designated by the organizer.
- Tickets purchased from a ticketing organisation are subject not only to the relevant sections of these GTC and the data protection declaration, but also to those of the ticketing organisation.
- Customers wishing to offer F&B or other hospitality services are obliged to conclude a separate contract with the service provider. Such cases are additionally governed by the provider’s GTC.
§ 9 Property clause
Items ordered from Basel 2021 remain the property of Basel 2021 until payment is complete.
§ 10 Guarantee exclusion
Prices, technical data and service descriptions appearing in flyers, brochures, catalogues, circulars, advertisements, media reports or price lists are purely informative. Basel 2021 offers no guarantee for their accuracy.
§ 11 Limitation of liability
- Liability for Basel 2021 follows the legal regulations unless otherwise stipulated in these GTC. Basel 2021, its representatives and/or helpers may only be held liable for direct damage caused deliberately or through gross negligence.
- Any liability for indirect or consequent damage is excluded. In the case of simple negligence and infringement of a contractual duty, liability for Basel 2021 is limited to the predictable and typical damage caused.
- Liability exclusions and limitations for Basel 2021 in these GTC apply also to the personal liability of employees, contractors, staff, representatives and agents of Basel 2021.
§ 12 Safeguarding clause
Basel 2021 reserves the right to change these GTC at any time. Changes will be published on the website and take effect from the moment of that publication. Should one or more of the stipulations in these GTC become entirely or partially inoperative or unenforceable, this has no effect on the remaining stipulations. The parties will in this case replace the inoperative or unenforceable stipulation with one that is fully applicable and enforceable and most closely meets the business intent of the replaced stipulation. The same principle applies in the case of any gaps in the terms and conditions.
Applicable laws
Any disputes will be governed exclusively by Swiss law and submitted to a court in Basel, Switzerland.
The German version of these GTC is binding.
